GENERAL RELEASE
1. Liability
1.1. In offering the services described in the selected study program, the School of Russian and Asian Studies (SRAS) has adhered to applicable professional standards in developing the program offered. SRAS assumes responsibility for its product offering under the terms and conditions specified within this Agreement. Liability for any disputes, damages or injuries incurred by either party to this Agreement shall be strictly limited to the terms specified herein and each party agrees to accept these terms as liquidated damages with no further remedy available.
1.2. The Participant acknowledges that there may be unforeseen circumstances resulting in loss or injury to the Participant that are not the responsibility of SRAS. The Participant hereby agrees to assume any and all risks that may occur outside the strict parameters of the program and to hold SRAS harmless for any such injury or loss. SRAS is not responsible for Participant's well being during periods of non-SRAS sponsored activities, such as independent travel, visits to friends and relatives, or non-SRAS sponsored social activities. Furthermore, SRAS is not responsible for Participant\'s well being once the Program has terminated, or if Participant chooses to stay on in Russia/Ukraine/Kyrgyzstan independently. Participant specifically waives any legal cause of action against SRAS for any action, intentional or non-intentional, by any third-party not a direct employee of SRAS.
1.3. The Participant specifically exempts SRAS, its agents, employee officers or their assigns, teachers, and related contractors from any financial obligations or liabilities that Participant may incur or any damage or injury to the person or property of others that Participant may cause while participating in this Program, and agrees to indemnify SRAS against any such financial obligations or responsibilities.
1.4. SRAS is not responsible for any loss or damage arising from any errors or omissions contained in any SRAS materials (electronic or print), other literature or communications (voice, mail, fax, email), late or non-confirmation or acceptance of bookings and loss or damage caused by delays. Additionally, SRAS reserves the right, at any time and at its discretion and without liability or cost to itself, to cancel any program or remainder thereof, or make an alteration in route, accommodation, price and/or details in the event of any program being rendered impossible or inadvisable by weather, strikes, war, acts of God, governmental interference or any cause whatsoever that is beyond the control of SRAS and its agents.
1.5. Participant agrees to waive any and all claims against SRAS and its agents or contractors domestic and overseas, my home academic institution, and any staff members or counselors accompanying the group, their heirs or estate, arising from any death, injury, loss, damage, accident, delay, irregularity, or expense to person or property incurred from the use of any vehicle or service, strikes, war, weather, sickness, quarantine, government restrictions or regulations, or arising from an omission of any steamship, airline railroad, bus company, metro, sightseeing agency, or hotel or any other service or transporting company, firm, individual, or agency. Agents of SRAS include, but are not limited to partner universities, their employees and staff, hosts (home stay), tour operators and their staff, and local representatives of SRAS.
2. Code of Conduct and Health Disclosure
2.1. Participant agrees to comply with the Program rules and regulations promulgated by SRAS, to maintain group standards of behavior as set forth by SRAS and/or its agents, and further to indemnify SRAS and/or its agents against any consequences which may ensue as a result of Participant's refusal to comply with such regulations. Participant agrees to take responsibility for exercising caution and common sense at all times to avoid injury to Participant or to others.
2.2. Participant agrees to grant to SRAS the right, at its sole discretion, to terminate Participant's program at any time in which said Program rules and regulations are not followed or if Participant engages in conduct potentially injurious to themself or to others, and to send Participant home at Participant's own (or parent/guardian's) expense, with the right to any refund of program fees thereby waived.
2.3. Participant certify that they are in good physical and mental health, and that they have informed SRAS of any special needs or requirements, including, but not limited to dietary, medical or physical restrictions. SRAS reserves the right to refuse an applicant on the grounds that special needs cannot be adequately satisfied within the Program. SRAS is exempt from any responsibility for special needs or requirements not disclosed as part of the Program application.
3. Releases
3.1. Participant agrees to allow any likeness taken of Participant while overseas by SRAS or its agents/partners to be used by SRAS for purposes of advertisement. To allow any statements in part or in their entirety written by Participant to be used by SRAS for purposes of advertisement or reference, as long as those statements are submitted to SRAS.
3.2. In the event that Participant becomes ill or incapacitated, Participant grants SRAS or any of its agents authority to take any action they feel is necessary in regards to Participant's health and safety, including securing medical treatment (at Participant's or Participant's parent/guardian's expense) and transporting Participant home, if necessary. Participant further releases any of these persons from any liability for such decisions or actions that may be taken on Participant's behalf. SRAS cannot be held responsible for the quality and timeliness of any medical care received, nor any expense incurred.
